ORDERS
Any order placed with us is subject to our acceptation and is only valid for the price, delivery time and payment terms mentioned above or detailed in our offices. Our proposals and estimates are only valid for the duration stated on them, or failing that, they shall only be valid for one month starting from their date of issue. Unless otherwise specified, none of our proposals are reputed to be all-inclusive. Any costs, parts or supplies, even those that have not been previously indicated, will be charged for if they are specifically required by the customer outside OPOOL’s usual scope of supply.
- PRICE
All our prices are ex-works and subject to perfectly respecting our conditions of sale. Our prices are fixed for all accepted orders. Our price list may be modified without prior notice. Our prices are stated excluding VAT and taxes will be added on as applicable on the day of delivery, in addition to shipping costs, custom duties or exchange rates, where applicable.
- DELIVERY TIMES
Delivery times and availability for orders, whether stated or not, are given as a guideline only. In the event of transport shortages, and if the object for sale is available on our premises, it is the responsibility of the customer to collect the object by his own means, not withstanding any particular agreement concerning shipping costs, should this be the case.
- SHIPMENT
In accordance with articles 105 and onwards of the trade legislation, goods are shipped at the recipient’s risk. The recipient is solely responsible for any reservation he may have on the shipment.
We reserve the right to refuse a carrier sent for by the contracting party if this carrier does not comply with the standards required by our workshops.
- EQUIPMENT: Warranty
It is imperative to respect the conditions of assembly and fitting of our equipment. We decline all responsibility in the event that these conditions are not scrupulously met. In the event of damages, whatever the cause may be, our warranty only covers our equipment. The warranty covering our equipment is only valid to the extent that the equipment is used in compliance with the instructions provided by our technical service. Returns of our equipment are only possible with our agreement, carriage paid and in its original packaging.
- PAYMENT TERMS
Upon placing an order, the customer shall pay 40% of the total amount, including all taxes. The balance shall be settled upon collection of the merchandise. In the event that different, special terms have been agreed upon, should any of these special terms not be respected, the outstanding balance shall be immediately payable. By accepting these terms, the customer authorises OPOOL to issue a bill of exchange at the agreed date that the customer shall accept, if applicable.
- TRANSFER OF OWNERSHIP
By accepting these terms, the customer agrees that ownership of the items of each order shall be transferred as and when full payment is effective.
- CLAIMS, JURISDICTION
The tribunal de commerce de Montpellier (Montpellier commercial court) is the only jurisdiction competent to settle any claim or dispute. In this event, the customer shall accept that OPOOL obtain a minimal compensation of one thousand, five hundred and twenty-five euros per claim or dispute, as penalty clause, if applicable.
